These Terms of Service govern your use of this website and your purchase of services from Full Presence Studio and products from Restore. By accessing this website or making a purchase, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using fullpresencestudio.com (“the Site”), purchasing web design services from Full Presence Studio, or purchasing products from Restore, you agree to these Terms of Service and our Privacy Notice. If you do not agree, please do not use this Site or our services.
These Terms apply to all visitors, clients, customers, and anyone who accesses or uses the Site.
2. Services — Full Presence Studio
Service Agreement
Web design services provided by Full Presence Studio are governed by the proposal and service agreement signed by both parties prior to the start of any project. These Terms of Service supplement but do not replace that agreement. In the event of a conflict, the signed service agreement governs.
Scope of Work
Services are provided as described in the project proposal. Any work beyond the agreed scope is subject to additional fees at $50.00 per hour and must be agreed upon in writing before work begins.
Client Responsibilities
Clients are responsible for providing accurate information, timely delivery of required assets, and prompt feedback within agreed timeframes. Full Presence Studio is not responsible for project delays caused by late or incomplete client submissions.
Intellectual Property
Upon receipt of final payment, the client receives full ownership of the completed website design. Full Presence Studio retains the right to display the completed work in a portfolio. All client-provided materials remain the property of the client. The client represents that they have the right to use all materials provided for the project.
Confidentiality
Full Presence Studio will treat all client information, business details, and project materials as confidential and will not disclose them to third parties without the client’s permission, except as required to provide the services (such as sharing assets with platform providers) or as required by law.
3. Products — Restore Candles (coming soon)
Product Descriptions
We make every effort to accurately describe our products, including scent profiles, materials, and dimensions. Because our candles are handcrafted in small batches, minor variations in appearance, color, and scent intensity are normal and are not considered defects.
Orders & Payment
By placing an order you represent that you are at least 18 years of age and that the information you provide is accurate and complete. All prices are in U.S. dollars. Payment is processed through Squarespace’s secure payment system. We reserve the right to cancel orders at our discretion, in which case a full refund will be issued.
Shipping
Orders are shipped via USPS Ground Advantage or USPS Priority Mail. Shipping times are estimates and not guarantees. Full Presence Studio is not responsible for carrier delays, weather events, or circumstances beyond our control. Please see our Shipping Policy for complete details.
Returns & Exchanges
Due to the handcrafted and consumable nature of our products, we do not accept returns or exchanges on candles unless the item arrives damaged or defective. If your order arrives damaged, contact us at hello@fullpresencestudio.com within 5 business days with photos and your order number. We will replace damaged items or issue a store credit at our discretion.
Candle Safety
By purchasing a Restore candle you acknowledge that you have read and will follow the care and safety instructions provided. You agree to use candles responsibly and in accordance with standard candle safety practices. Full Presence Studio is not liable for any damage, injury, or loss resulting from improper use of our products.

Permitted Use
You may use this website for lawful purposes only. You agree not to use this Site in any way that violates applicable laws or regulations, infringes on the rights of others, or interferes with the operation of the Site.
Intellectual Property

5. Payment Terms
Web Design Services
A non-refundable deposit of 50% is required before any project work begins. The remaining balance is due before the final deliverable is released. All invoices are processed through Stripe Payments and are due upon receipt. Work does not begin until both a signed proposal and deposit payment have been received.
Candle Orders
Payment is collected in full at the time of purchase through Squarespace’s secure checkout. We accept all major credit and debit cards. We do not store payment information on our servers.
Chargebacks
If you initiate a chargeback with your bank without first contacting us to resolve the issue, we reserve the right to dispute the chargeback and to decline future service. We are always willing to resolve issues directly — please reach out before contacting your bank.
6. Limitation of Liability
To the fullest extent permitted by law, Full Presence Studio and Restore (“We,” “Us,” or “Our”) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site, our services, or our products.
Our total liability to you for any claim arising from your use of our services or products shall not exceed the amount you paid us for the specific service or product giving rise to the claim.
We are not responsible for any loss of data, loss of business, or loss of profits arising from the use or inability to use our services or products.
7. Disclaimer of Warranties
This Site and our services are provided “as is” and “as available” without any warranty of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Indemnification

9. Governing Law & Disputes
These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of our services or products will first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes will be resolved through binding arbitration in Portsmouth, Virginia, in accordance with the rules of the American Arbitration Association.
You agree to bring any claim individually and not as part of a class action or class arbitration.
10. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be effective immediately upon posting to the Site with an updated “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.
For significant changes we will make reasonable efforts to notify you, such as by posting a notice on the Site or sending an email to customers with active accounts.
